Menklusser, based in Amstelveen, is registered with the Chamber of Commerce under number 90454227. Our general terms and conditions apply to all quotes, agreements, and services provided via www.menklusser.nl or directly through our email address info@menklusser.nl.

Article 1: Definitions

1.1. Contractor: Menklusser, located in Amstelveen, registered under Chamber of Commerce number 90454227.
1.2. Client: The natural or legal person who enters into an agreement with Menklusser.
1.3. Services: All renovation, construction, and maintenance work, including bathroom and home renovations, roof extensions, and other agreed tasks.
1.4. Agreement: The contract between the Client and the Contractor, detailing the work and applicable terms.

Article 2: Applicability

2.1. These terms and conditions apply to all quotes, agreements, and work carried out by Menklusser.
2.2. Deviations from these terms are only valid if confirmed in writing by both parties.
2.3. The Client’s general terms and conditions are expressly rejected.

Article 3: Quotes and Agreement

3.1. All quotes provided by Menklusser are non-binding and valid for 30 days unless stated otherwise.
3.2. An agreement is established once the Client provides written approval of the quote.
3.3. Any modifications to the agreement are only valid with written consent from both parties.

Article 4: Execution of Work

4.1. Menklusser will perform the work to the best of its ability, in accordance with the agreed-upon schedule and specifications.
4.2. If adjustments are necessary during execution, this will be discussed with the Client and confirmed in writing.
4.3. The Client must ensure that Menklusser has timely access to the worksite and that the conditions are safe and suitable for work.

Article 5: Payments

5.1. Payments must be made within 14 days of the invoice date unless otherwise agreed.
5.2. If payment is overdue, the Client is in default and statutory interest will be charged.
5.3. All costs, both judicial and extrajudicial, incurred by Menklusser to collect the payment are borne by the Client.

Article 6: Warranties

6.1. Menklusser guarantees that the completed work meets the agreed specifications and quality standards.
6.2. Any defects must be reported in writing within 14 days of completion.
6.3. The warranty is void if defects result from improper use or work performed by third parties.
6.4. Menklusser gives 10 year of warranty on the services they deliver.

Article 7: Liability

7.1. Menklusser is only liable for direct damage caused by gross negligence or intent.
7.2. The liability of Menklusser is limited to the amount paid by the Client for the relevant work.
7.3. Menklusser is not liable for indirect damage, such as consequential damage or lost income.

Article 8: Force Majeure

8.1. In cases of force majeure, Menklusser is not obligated to fulfill the agreement. Force majeure includes circumstances beyond Menklusser’s control, such as weather conditions, strikes, or material shortages.
8.2. If the force majeure persists for more than 30 days, both parties have the right to terminate the agreement in writing.

Article 9: Cancellation

9.1. The Client may cancel the agreement in writing, in which case Menklusser is entitled to compensation for costs already incurred.
9.2. If cancellation occurs within 14 days before the start of the work, the Client owes 25% of the agreed amount.

Article 10: Governing Law

10.1. Dutch law applies to all agreements between Menklusser and the Client.
10.2. Disputes will preferably be resolved amicably. If this is not possible, disputes will be submitted to the competent court in the district where Menklusser is located.
